As a condition of using this website, you agree to comply with and be subject to all of the following terms and conditions of use.

Personal Information

Prince Newcastle Pty Ltd trading as The Prince of Merewether (ABN 56616414067) collects your personal information when you place an order with The Prince. Our Privacy Policy provides details of how The Prince collects, uses and discloses your personal information, how you can access your personal information or raise a complaint about the management of your personal information.

Pickup and delivery terms of alcohol

We take the responsible service of alcohol seriously. In accordance with the Liquor Act 2007, it is against the law to sell or supply alcohol to, or to obtain liquor on behalf of, a person under the age of 18 years. We will therefore request to see your valid ID when you come to pickup your order. When placing an order with The Prince via the website or via phone, you confirm that all the details that you have provided in completing the order and offer to purchase are true and correct. It is a condition of purchase that you verify that you are 18 years of age or over for any liquor purchases. If you do not confirm that you are 18 years or over for liquor purchases, your order will not be processed.

You agree that we may rely on any person who is sent to collect the order that you placed, and who takes receipt of your ordered products, as being authorised for that purpose.

We will not allow pickup of your order if we consider any pickup circumstances may be unsuitable for any reason, including because any likely recipient of the ordered products appears to our staff to be under the influence of alcohol or drugs, or, for orders containing alcohol under the age of 18 years or acting for or on behalf of a person who we consider may be unsuitable for any reason (including because they may be under 18 years).

We may not allow pickup of any order containing alcohol if any of our requests for verification (such as proof of identity or age) are not met.

Pickup times

We will endeavour to have your order ready for pickup within the times nominated at the time of your order. You accept the risk that occasionally, due to circumstances which we have not foreseen, pickup times may be longer than times nominated for.

Non-collection

For food orders, if we prepare your meal and you fail to collect it we will not provide any refund.

Refund Policy

The Prince will not be responsible for any loss or deterioration which occurs subsequent to pickup due to non-timely collection or otherwise. Please select your meals carefully as no refund or exchange will be given if you change your mind after ordering.

If you did not love your meal then please let us know. We will replace or refund your order and make sure that your next experience with us is a great one! Please be aware that while we do everything from our end to complete this refund as soon as possible, it may take up to 10 business days for the refund to be processed, depending on your financial institution and the transaction type (ie Credit card, Paypal).

For bottleshop products, if you change your mind or wish to cancel your order, we will provide a refund or exchange on unopened purchases (excluding fresh growler or squealer products) within 7 days. Simply return the item to us along with proof of purchase and we will process the transaction.

Online Payment

We only accept online payment by providing your credit card details during checkout on our secure site. We will process your order payment using your credit card details for the value printed on the tax invoice we provide with your delivery. All transactions are sold and processed in Australian dollars (AUD). We accept both Visa and Mastercard only on this secure site.

Credit card details are handled by a third party payment gateway (EWay), and The Prince will never save your actual card details.

For the avoidance of doubt, The Prince will not in any circumstance be liable to you, or any third parties, for any loss or damage you may suffer arising from credit card fraud or identity theft.

Video Surveillance

In order to provide a safe and secure environment for our patrons and employees, our venue is under constant video surveillance. Video footage is retained for 28 days unless required for an investigation in respect of, for example, a breach of security or suspected illegal or suspicious activities. Please note that retaining the video footage is a licensing requirement. All persons movements upon entering licensed premises will be subject to monitoring by security systems such as but not limited to CCTV and body worn video which includes audio. By entering you agree to the terms of our Privacy Policy.

Information obtained from third parties

We may obtain personal information concerning you from third parties, including from: people making enquiries or bookings on your behalf, providers of any meetings or event services which are enquired about or booked with us, and people referencing you in posts on our social media channels. Our online booking system is provided by a third party. We collect the personal information you provide in respect of a booking made via this system, such as your name, email address and phone number.Our online ordering system is also provided by a third party. We collect the personal information you provide in respect of purchases through this system such as your name, email address and phone number.

Cookies

Cookies collect information that includes the server your computer or device is logged onto, your browser type and how you gained entry to our website. Therefore, when you visit our website anonymously, details are recorded about your visit, such as time and date, pages accessed and time spent on the website, in addition to the matters described above. This information is used in an anonymous form for statistical purposes and, as such, cannot be used to identify you individually. Use of User Generated Content (UGC): By submitting UGC to our social media channels or website you grant us a non-exclusive licence to use the Submissions you add to our website. For example, we may use this information in any of our brochures or for our campaigning purposes or marketing materials.
